Discord Membership Refund & Return Policy

1. Refund Window

Refund requests for eligible BD Investing Discord membership purchases must be submitted within 3 calendar days of the original purchase date.

Requests submitted after this window are generally not eligible for a refund, except where required by applicable law.

2. How to Request a Refund

Refund requests are handled through Whop, the platform used for membership payments.

To request a refund, submit your request through your Whop account or the applicable Whop order or support process.

Please include the following information:

Email address associated with your purchase.

Order number or transaction identifier.

Original purchase date.

Brief description of your refund request.

For your security, never share passwords, payment card numbers, or other sensitive account credentials.

3. Subscriptions and Cancellation

Members can manage or cancel their subscriptions through Whop.

Cancelling a subscription stops future renewals according to the applicable Whop billing terms.

Cancelling a subscription does not automatically refund previous payments.

Refund requests must be submitted separately within the eligible refund window, subject to applicable consumer protection laws.

4. Digital Access

BD Investing Discord memberships provide access to digital educational content, investing research, market commentary, and community services.

When a refund is approved, associated paid membership access may be revoked.

BD Investing does not guarantee investment returns, trading profits, or specific financial outcomes.

5. Refund Processing

Approved refunds are processed through Whop and generally returned to the original payment method where supported.

The time required for a refund to appear depends on Whop, the payment processor, and your financial institution.

BD Investing cannot guarantee a specific refund posting date.

6. Consumer Rights

This Refund & Cancellation Policy does not limit or override any non-waivable consumer protection rights.

This includes rights that may apply under Ontario consumer protection legislation or other applicable laws.

Where mandatory legal refund or cancellation rights apply, those rights take precedence over this policy.

END USER LICENSE AGREEMENT

1. Parties and Acceptance

This End User License Agreement ("EULA") is between BD investing & Marketing inc. ("BD Investing," "we," "us") and the individual or organization accessing a licensed digital product ("you").

By downloading, installing, accessing, or using a covered product, you agree to this EULA.

If you do not agree, do not use the product and contact us about any applicable cancellation or refund rights.

2. Products Covered

This EULA applies to software, trading-related tools, AI-powered tools or bots, indicators, scripts, dashboards, downloadable resources, and other digital products that BD Investing expressly makes available under this EULA (collectively, "Licensed Products").

Website use, Discord memberships, courses, and general research are also governed by our Terms of Service.

Product-specific terms shown at purchase or within a product may supplement this EULA. Mandatory law prevails where applicable.

3. Limited License

Subject to payment of applicable fees and compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Licensed Products for your own internal, lawful purposes during the purchased access term.

You receive a license, not ownership of the software or intellectual property.

Any commercial or team use requires our prior written permission unless the product offer explicitly permits it.

4. Permitted Use and Account Security

You may use Licensed Products only as documented and through authorized accounts, devices, or integrations.

You are responsible for safeguarding login details, API keys, brokerage permissions, and connected accounts.

Do not share credentials or give third parties access under your license.

Notify us promptly of suspected unauthorized access.

5. Restrictions

Except where applicable law expressly permits otherwise, you must not:

Copy or redistribute Licensed Products.

Resell, rent, sublicense, or publicly share access.

Remove ownership notices.

Attempt to extract source code or circumvent access controls.

Interfere with services.

Use products for unlawful trading or market manipulation.

Present our content or software as your own.

These restrictions do not limit rights that cannot legally be excluded.

6. Investing and Automated Tools Risk

Licensed Products are educational and analytical tools, not individualized financial advice or a promise of trading performance.

Outputs, alerts, simulations, backtests, and AI-generated analyses can be wrong, incomplete, delayed, or unsuitable for live markets.

Automated trading can execute unwanted orders, suffer outages, or lose money rapidly, including more than an initial investment where leverage is used.

You must independently review all settings, permissions, orders, and risks before using a tool with real funds.

No product guarantees profits, accuracy, availability, or avoidance of losses.

7. No Discretionary Account Management

BD Investing does not take custody of customer assets, trade on your behalf, or provide copy trading under this EULA.

Any brokerage or exchange connection remains subject to the third party's terms.

You control whether and how your accounts are connected and the permissions you authorize.

8. Fees, Renewals and Refunds

Prices, access periods, taxes, and any auto-renewal terms are disclosed at checkout, including where payment is processed through Whop or another provider.

Subscription cancellation and refund eligibility are governed by the terms disclosed at purchase, our posted Refund Policy, and mandatory consumer law.

A three-calendar-day voluntary refund window may apply to eligible initial purchases. This does not remove statutory rights.

9. Updates and Changes

We may issue patches, security updates, or feature changes, and may discontinue features where reasonably necessary.

Some updates may be required for continued safe use.

We will provide notice of material changes when required by law.

We do not promise any specific feature, integration, or support period unless expressly stated in the product description.

10. Third-Party Services

Licensed Products may depend on brokers, exchanges, data vendors, cloud providers, Discord, Whop, or other services.

Those services have their own terms, fees, restrictions, and privacy practices.

We are not responsible for third-party outages or decisions to the extent permitted by law.

You are responsible for complying with third-party requirements.

11. Ownership and Feedback

BD Investing and its licensors retain all rights in the Licensed Products, branding, code, documentation, and related intellectual property.

You retain ownership of information you lawfully provide.

If you submit product suggestions, we may use them to improve our services without an obligation to compensate you, subject to applicable law and our Privacy Policy.

12. Privacy and Data

Personal information handled in connection with Licensed Products is governed by our Privacy Policy at BDInvesting.org.

Depending on the product, account identifiers, purchase records, support communications, usage information, or technical diagnostics may be processed.

Product-specific data access and integrations should be disclosed before activation.

Do not provide brokerage passwords or sensitive credentials to anyone claiming to represent us through direct messages.

13. Suspension and Termination

We may suspend access where reasonably necessary for security, suspected fraud, legal compliance, or a material breach of this EULA.

Where appropriate, we may provide notice and an opportunity to remedy a breach.

Upon termination, your license ends and you must stop using and delete copies where technically possible, subject to rights preserved by law.

Sections intended to survive termination, including intellectual property and dispute provisions, continue to apply.

14. Disclaimers

To the extent permitted by law, Licensed Products are provided on an "as available" basis without warranties of uninterrupted operation, error-free results, fitness for a particular trading purpose, or compatibility with any brokerage.

Nothing here excludes consumer guarantees, statutory warranties, or other protections that cannot legally be excluded.

15. Limitation of Liability

To the extent permitted by applicable law, BD Investing is not responsible for indirect or consequential losses arising from use of Licensed Products, including lost trading opportunities, investment losses, or data interruptions.

Nothing in this EULA limits liability for fraud, intentional misconduct, or other liability that cannot legally be limited.

Any additional monetary liability cap must be expressly disclosed and legally reviewed before adoption.

16. Governing Law and Disputes

This EULA is governed by the laws of Ontario and applicable federal laws of Canada, subject to mandatory protections and jurisdictional rights that apply to you.

Nothing requires you to waive statutory remedies or access to courts or regulators where such rights cannot be waived.
